I am on 7th year of H1B with approved 140. 485 not filed yet.
My company is starting layoff and I am afraid I will be hit. If I switch to H4 after being laid off and found a new employer in future, is that possible to switch back to H1B without having to leave the country for a full year?
My current H1B was a three year extension based on approved 140, but I don't know if I will lose the benefit of AC21 and cannot change back to H1B once I switch to H4 since my 6 years have been used up already.
thanks in advance.

Hi,
I have my labor certiifcation approved and currently filed for I-140.
I-140 is not approved yet.
I have an offer from another employer with very similar job profile.
My 6 yrs of H1 is getting over in 2010 summer.
My prioriy date is Dec/07.
What are my options
1) Can i change a job and keep same priority date(as job profile is very similar)
2) Do I have to start from zero again? If yes,how much time I have to get priority date assigned again(considering my H1 bgets over in 2010 summer?)
I will appreciate your comments
Thanks

Hi
I am currently on L2 visa with EAD and working for a company as direct employee. My wife is in L1. Both of our visas,I-94 and my EAD are valid till OCT-2010.
My wife has to go back to India as her current project is over.
My question is can a L2 visa holder with EAD stay back and continue working in U.S.A, after L1 has left the country ?.
Any information regarding this is highly appreciated.
Thanks in advance.

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

If you go to the USCIS website (www.uscis.gov) you can download the EAD application and the list of documents that you are required to submit. My understanding is that the location where you file your EAD is dependent on the State where you live. The EAd application instructions include information on where to file depending on the State where you live.

My friend Tamar Jacoby of ImmigrationWorksUSA joins former Mexican Foreign Secretary Jorge Castenada in writing in today's Washington Post about what could be the biggest area of division in the coming reform debate - how to handle future workers. Some are proposing to put off discussions of this topic until the economy improves or to set up a commission to deal with the issue. Here is what Jacoby and Castenada have to say on the subject: When the economy begins recovering, U.S. housing starts will climb, restaurants will fill up again, Americans will take the vacations they've been putting off...

October is usually a month where we see improvements as new visa numbers become available for a new fiscal year. Most categories showed forward movement though few jumps of more than a few months. The exception is the Mexico Family 1st category which jumps a year and a half. EB-3 is available again, but not set at a date particularly close. Most people will not be happy with the dates. Here are the numbers showing comparison to the September Visa Bulletin: Family 1st - Advancement of worldwide, China and India numbers by nine weeks to 22 JUL 2003. Mexico jumps...

Degrees evaluation says "UNITED STATES DEGREE EQUIVALENT BACHELOR OF SCIENCE DEGREE IN COMPUTER SCIENCE"

Am I eligible for EB2 category, as my employer says, EB2 be most likely would be rejected/denied and its a big risk
Let me know your inputs.
Thanks

Antis often say that as long as people play by the rules they don't have a problem with having a robust immigration system. But consider the Franks, a British couple awarded an E-2 visa ten years ago who have poured their savings and their blood, sweat and tears in to a restaurant that they were given permission to open and operate. The New York Times told their story today. In their latest extension, however, an anonymous USCIS examiner decided their restaurant in Maine was no longer up to snuff and ordered the couple to leave the country even though the...

Can I apply another I140 with the old empoyer without revoking the one that I have with the current employer as I want to stay with the current employer till I get the new I140 approved? Will applying the I140 with the old affect my current I140 approval.

I heard a fascinating interview of Kati Marton by Bob Edwards this weekend and am going to buy her new book Enemies of the People. The Hungarian-born Ms. Marton is a former ABC News reporter and NPR international correspondent. Journalism is in her blood. Her parents were reporters in Hungary for UPI and the AP and they risked their lives trying to report the truth in that country in the years leading up to the 1956 revolution. She writes about her parents' arrests by the secret police and the experience of living her first eight years in Hungary in her...

Iranian-born Omid Kordestani was Google's 12th employee and he is one of the key executives who has turned the firm in to one of the world's most successful companies. I just read an interesting article about Kordestani where he credits his immigrant background for much of his success and urges America's young people to adapt an immigrant mindset: To keep an edge, I must think and act like an immigrant. There is a special optimism and drive that I benefited from and continue to rely on that I want all of you to find. Immigrants are inherently dreamers and fighters...

From DHS Deputy Press Secretary Matt Chandler: The courts decision to enjoin most of SB1070 correctly affirms the federal governments responsibilities in enforcing our nation's immigration laws. Over the past eighteen months, this Administration has dedicated unprecedented resources to secure the border, and we will continue to work to take decisive action to disrupt criminal organizations and the networks they exploit. DHS will enforce federal immigration laws in Arizona and around the country in smart, effective ways that focus our resources on criminal aliens who pose a public safety threat and employers who knowingly hire illegal labor, as well as...
