Hi Folks
just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
are there some other ways where GC-> Citz can be expedited

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.
Has anybody done that.

Hi,
My first NIW/I140 was concurrent filed with I485 for both my wife and me. When they denied I140, the USCIS also denied I485s for both of us. I have a pending MTR for that I140.
I then filed another NIW/I140, which was approved. Surprisingly, and I just noticed that, the approval notice has the A# that was on the I485 of the first petition.
So, should I assume that my the USCIS has interfiled my I485 automatically and my old PD is active?
If yes, 1) Is there a way to confirm this, and 2) do I still have to file MTR for the my I485 that was denied, and 3) Since it has been 6 months since the PD, am I eligible for EAD under AC21?
Also, what will happen with my wife�s I485? Since the original I485 was denied, will interfiling be okay or should we MTR it?

My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?
2) Does the service center really matters as it will take a very long time for me to get greened?
3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?

I am not able to figure out if this new Merit Based System (if implemented is good or bad for us)
If the guys who already have made some progress using the existing system are asked to re-apply under this new merit based system, it is going to be bad for them, because they have to go through the entire process again.
What about people like me, who are new commers to US ?
If I apply under the new merit based systems, am I automatically subjected to backlog, because people who applied for GC under the previous system have not yet gotten their GCs, or this new merit based system will have its own quote ?
Can anyone explain ?

I have a few questions regarding my H1B and I-140 since I am planning to change my employer.
1) If I change my employer, can my old employer retain my I-140? If he retains my I-140 and in case if the GC dates become current can I switch back to my old employer along with H1 and get my GC through old employer? Will this situation involves complications?
2) After my H1B transfer is approved with new company, when can I go for H1b stamping? Can I go immediately or wait for 1 month or so, in order to run 2 pay checks with the new company?
3) I had my initial H1B visa stamped from Bahamas. Can I still go to US neighboring countries to get my H1B visa stamped since mine is H1B transfer/extension and not change of status or do I have to go to India?
4) If I have my H1B stamped with old employer, and later transfer my H1b, Will I be able to travel to India with H1B stamping from old employer or Do I need to again have my H1B stamped?

Does anyone know answer to my question? GC processing for family based has preferences 1, 2A, 2B, 3, 4 and then employment based has EB1, EB2, EB3 and so on. In what sequence USCIS assigns GC to these categories taking into consideration per country 7% limit? For example, 1 GC to family 1, then 1 to family 2A, then 1 to emp EB1 etc (a hypothetical sequence). Any idea?
