Approaching a senator is always okay. You don't have to prove that you are a taxpayer to get a senator's help. It may or may not help but it definitely is still worth a try. Note that if the senator provides some help and the wife and child visits for graduation day the visa status applications should most probably be for B1's (visitors).

I am on H4 visa now and when I was on F2 visa I have used medicaid and wic for prenatal care. It was used during my pregnancy only. I am never asked for that in my h4 visa inteviews. Since my husband is applying for CP for green card . Will it be a problem for me to go for CP ? Will consular office consider it a public charge and deny my GC ? Just in case if I get denial how to overcome that denial ? is there a standard process ? Will it affect my husband's GC ?

My wife is going for h1b stamping in Chennai on Jan 17th. She converted from H4 to H1 and and is doing her first year residency in a community hospital in New York. We have all required documentation. Letter from Hosp, 797, 129, LCA, offer letter, ECFMG certification, USMLE transcripts, degree, school transcripts.
In addition, I am asking her to take utility bills and bank certificates and paystubs.
As she was in h4 for 2 years, would the VO be asking her for my stuff like, my w2s, my paystubs etc????
Has anyone gone through this? Any specific questions related to residency? Does she need to take information about the hospital like brochures, etc.... does a visa interview for a Physician focus on the hospital and its operations????

My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

The Memphis Commercial Appeal reports on today's citizenship swearing in of Irish-born James Patrick O'Donnell. Mr. O'Donnell immigrated to the US at the age of 4 in 1926 and fought for our country in World War II and won a Bronze Battle Star. Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."
My hope is over now...All the best to all who r lucky.

Hi all.
I just came back from Canada after 4 days using 30 day rule as I wanted to recoup few days so that my co. can apply for 7th year extension because my LC shall be pending for more than 365 days. My question is does my employer have to file two seperate LCAs for each I-129 application or same LCA copy can be attached with each I-129 ( 1st I-129 for extension for 3 days, 2nd I-129 for 1 year extension ) ?
( NOTE- MY I-94 WAS EXPIRING ON 15TH MAY AND LABOR CERT. SHALL BE PENDING FOR MORE THAN 365 DAYS ON 17TH MAY, SO I HAD TO TRAVEL OUTSIDE USA TO RECOUP FEW DAYS)

Hi,
I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

A friend of mine (Indian) is married to an Indonesian. Both are on H1B and have approved I-140s. Can my friend apply for a cross chargeability? Does it have to happen when my friends spouse's pd becomes current? or can it be done earlier?

* AILA has reported that during the period of July, August, and September 2007, Nebraska Service Center and Texas Service Center adjudicated 60,000 plus EB-485 applications. Since EB visa number was unavailable for the entire EB cases in August, presumedly a substantial portion of these cases could include those cases for which the EB visa numbers were pull out before July 2, 2007 in June and adjudicated throughout the period as reported by some I-485 applicants who reported that their I-485 applications were approved when the visa number was unavailable. Interesting.

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.
